2. Service Contractual Agreement
All home renovation services are governed by formal written contracts or agreements delineating project scope, detailed specifications, established timelines, payment schedules, warranty provisions, and mutual responsibilities of both contracting parties. No verbal representations or modifications constitute binding obligations unless formally documented and signed by authorized representatives.
3. Payment Terms & Schedules
Payment structures are outlined within individual project contracts following these typical frameworks:
- Initial Deposit: 30-50% due upon contract execution securing scheduling and premium material procurement
- Progress Installments: Due at predetermined project milestones (typically 20-30% each phase)
- Final Payment: Remaining balance due upon substantial completion and satisfactory final walkthrough
- Overdue balances may incur interest charges of 1.5% monthly on outstanding amounts
4. Project Modification Protocol
Change requests must be submitted in writing and receive formal approval from both parties prior to implementation. Approved modifications may affect project duration, total investment, and resource allocation accordingly. Change orders document modifications comprehensively, associated cost implications, timeline adjustments, and require client signature authorization before proceeding.
5. Cancellation & Refund Framework
Cancellations must be submitted in writing. Refund eligibility depends upon cancellation timing and work progression:
- Within 72 hours of contract signing: Full refund minus 5% administrative processing fee
- Following work commencement: Refund covering unused materials plus prorated labor costs exclusively
- Post substantial completion: No refund applicable; warranty provisions govern instead
- Client-initiated cancellations for convenience may incur additional reasonable charges
6. Warranty Provisions
All completed work carries warranty coverage as specified within project contracts and accompanying warranty documentation. Standard warranties address defects in workmanship and materials under normal usage conditions. Warranties exclude damage resulting from misuse, neglect, unauthorized alterations, ordinary wear and tear, or force majeure events. Claims must be reported promptly and will be addressed according to established procedures.
7. Liability Limitations
Protectify Home Plans maintains comprehensive liability insurance as described elsewhere. Our aggregate liability for any claim arising from rendered services shall not exceed the total amount paid by the client for the specific project generating said claim. Client agrees to indemnify and hold harmless Protectify Home Plans from claims arising from client-provided materials, decisions outside our control, or unauthorized post-completion modifications.
8. Property Access & Safety Protocols
Client must provide reasonable access to designated work areas during scheduled operational hours. Client assumes responsibility for securing valuables, relocating pets, and safeguarding sensitive areas preceding work initiation. Both parties share responsibility for maintaining safe worksite conditions. Children and pets must remain outside active construction zones for safety reasons.
9. Intellectual Property Rights
All designs, plans, drawings, specifications, and creative materials developed by Protectify Home Plans remain our intellectual property pending full payment receipt. Upon complete payment settlement, clients receive limited licenses utilizing delivered materials for property-specific purposes exclusively. Resale, distribution, or commercial exploitation of proprietary materials absent explicit permission remains strictly prohibited.
10. Dispute Resolution Mechanism
Should disputes arise concerning these terms or service agreements, both parties commit to good-faith negotiation before pursuing formal remedies. Should negotiation prove unsuccessful, disputes shall proceed through binding arbitration conducted in Harrisburg, South Dakota, according to American Arbitration Association rules. Each party bears respective attorney fees unless arbitrator determines alternative allocation appropriate.
11. Governing Jurisdiction
These Terms and Conditions and all affiliated agreements shall be governed by and construed according to laws of the State of South Dakota, disregarding conflict-of-law principles. Any legal proceedings shall originate exclusively within state or federal courts situated in South Dakota, or surrounding jurisdictions.
12. Terms Modification Rights
Protectify Home Plans reserves unilateral authority modifying these Terms and Conditions periodically. Modifications become effective immediately upon website publication. Continued service utilization or website interaction following changes constitutes implicit acceptance of modified provisions.
